Terms of Service

These terms govern web hosting, email and related services supplied under the mobuhost brand.
1. Who we are
mobuhost is a service of Suasor AB, a company registered in Sweden, organisation number 556987-9348, VAT number SE556987934801, registered address Klippergatan 14, 1104, 211 75 Malmö, Sweden.
Contact: info@mobuhost.com. We call ourselves "we" or "mobuhost" below, and you "you" or "the customer".
2. What you are buying
A hosting account on shared infrastructure, sized by the plan you chose. Each customer gets their own isolated cPanel account, not a folder inside somebody else's.
The plan limits are real numbers, not marketing:

Nothing we sell is unlimited. If you reach a limit, the service keeps running but you cannot add more of that resource until you upgrade or free some up.
Website design and build work is a separate service, quoted separately, and is not covered by these terms.
3. Backups: read this one
We do not currently provide a backup service, and you should not rely on us for one.
You are responsible for keeping your own copies of your website files, databases and email. Our upstream infrastructure provider may hold backups for their own operational purposes, but we do not promise that any such backup exists, that it covers your data, or that it can be restored on request.
If this changes we will update these terms and say so on the website. Until then, treat your hosting account as the only copy, and keep another one.
4. Availability
We aim to keep your site online and we will act on problems as fast as we reasonably can, but we do not offer a guaranteed uptime percentage. We would rather promise nothing than promise a number we cannot measure.
Services may be unavailable during maintenance, during faults at our infrastructure provider, or during events outside our control.
5. Support
Support is by email at info@mobuhost.com. We answer as quickly as we can. We do not currently promise a response time, and any plan feature named "priority support" would be meaningless today, so we do not sell one.
6. Payment, renewal and cancellation
Fees are billed in advance for the chosen billing period and are due on the invoice date. Service renews automatically at the end of each period unless you cancel.
You may cancel at any time, effective at the end of the period you have already paid for. We do not refund the unused part of a period, except where the law requires it or where we have failed to deliver the service.
If an invoice remains unpaid we may suspend the service after giving you notice by email, and may delete the account and its data after a further reasonable period. Do not let an account lapse if you have no backup of your own.
Prices may change. We will give at least 30 days notice by email before a price change takes effect, and you may cancel before it does.
7. Domain names
Domains are registered through a third-party registrar and are subject to that registrar's terms and the rules of the relevant registry.
- Domain fees are not refundable once a registration or renewal has been submitted.
.sedomains require the registry's mandatory registrant identification, which means we have to collect an identity number, passport number or VAT number from you.- You are responsible for keeping your registrant contact details accurate. Registries can suspend a domain for invalid data.
- A domain registered on your behalf is yours. If you leave, we will not hold it hostage, and we will provide the transfer code on request from the registered contact.
8. Consumers
If you are buying as a consumer rather than for a business, you have a 14-day right of withdrawal under Swedish distance selling law. If you ask us to start the service inside those 14 days, you accept that the right of withdrawal ends once the service has been fully provided, and that we may charge you for what has already been delivered.
Nothing in these terms limits your mandatory rights as a consumer under Swedish law.
9. Your responsibilities
You must keep your account credentials secure, keep any software you install (WordPress, plugins, themes) up to date, and comply with the Acceptable Use Policy, which forms part of these terms.
You are responsible for the content you publish and for having the right to publish it.
10. Suspension and termination
We may suspend or terminate an account that breaches the Acceptable Use Policy, that is being used unlawfully, that endangers the stability or reputation of the shared server, or whose invoices remain unpaid.
Where the circumstances allow it we will contact you first and give you a chance to fix the problem. Where they do not, for example an active phishing site or an ongoing attack, we will act first and tell you immediately afterwards.
11. Liability
We provide the service with reasonable skill and care. We are not liable for indirect or consequential loss, for lost profits, or for lost data where you have not kept your own copies, and see section 3 on backups.
Our total liability for any claim is limited to the fees you paid us for the service in the 12 months before the claim arose.
Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or a consumer's mandatory statutory rights.
12. Changes to these terms
We may update these terms. For changes that materially affect you we will give at least 30 days notice by email, and you may cancel before they take effect. The current version is always published at mobuhost.com.
13. Law and disputes
These terms are governed by Swedish law. Disputes go to the courts of Sweden, with Malmö tingsrätt as the first venue.
If you are a consumer you may instead bring a complaint to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, arn.se) or through the European Commission's online dispute resolution platform.
